Điều chỉnh giấy phép xây dựng là gì?
Theo Điều 90, Luật Xây dựng năm 2014, giấy phép xây dựng gồm những nội dung cơ bản sau:
1. Tên và địa chỉ của chủ đầu tư.
2. Tên công trình, loại công trình, cấp công trình xây dựng.
3. Địa điểm, vị trí xây dựng công trình; tuyến xây dựng công trình đối với công trình theo tuyến.
4. Cốt xây dựng công trình, chỉ giới đường đỏ, chỉ giới xây dựng.
5. Mật độ xây dựng, hệ số sử dụng đất (nếu có).
6. Đối với công trình dân dụng; nhà ở riêng lẻ; công trình công nghiệp; ngoài các nội dung trên còn có nội dung về tổng diện tích xây dựng; diện tích xây dựng tầng 1 (tầng trệt); số tầng (gồm cả tầng hầm, tầng kỹ thuật, tầng tum, tầng áp mái); chiều cao tối đa toàn công trình.
7. Thời hạn khởi công công trình không quá 12 tháng tính từ ngày được cấp phép xây dựng.
Luật Xây dựng năm 2014 nêu rõ, chủ đầu tư phải xin điều chỉnh giấy phép xây dựng nếu trong quá trình triển khai xây dựng trên thực tế có điều chỉnh thiết kế làm thay đổi một số nội dung của giấy phép đã được cấp.
Trong một số trường hợp, điều chỉnh giấy phép xây dựng là phương án nhằm hợp thức hóa hành vi xây dựng không đúng với nội dung giấy phép được cấp (xây dựng trái phép). Việc điều chỉnh giấy phép xây dựng đã cấp được quy định tại Luật xây dựng năm 2014 và Thông tư 15/2016/TT-BXD.
Trường hợp nào phải điều chỉnh giấy phép xây dựng?
Thứ nhất, thay đổi hình thức kiến trúc mặt ngoài của công trình đối với công trình trong đô thị thuộc khu vực có yêu cầu về quản lý kiến trúc.
Thứ hai, thay đổi một trong các yếu tố về diện tích, vị trí xây dựng; số tầng, chiều cao, quy mô của công trình cũng như các yếu tố khác ảnh hưởng đến kết cấu chịu lực chính của công trình.
Thứ ba, khi điều chỉnh thiết kế bên trong công trình mà làm thay đổi công năng sử dụng và ảnh hưởng đến an toàn, phòng, chống cháy nổ, bảo vệ môi trường.
Quy trình, thủ tục điều chỉnh giấy phép xây dựng
Việc điều chỉnh giấy phép xây dựng được thực hiện theo các bước sau đây:
Bước 1: Chuẩn bị hồ sơ
Cá nhân, chủ đầu tư cần chuẩn bị 2 bộ hồ sơ gồm các loại giấy tờ sau:
1. Đơn xin điều chỉnh giấy phép xây dựng theo Mẫu số 02.
2. Bản chính giấy phép xây dựng đã được cấp.
3. Báo cáo kết quả thẩm định; văn bản phê duyệt thiết kế xây dựng điều chỉnh (ngoại trừ nhà ở riêng lẻ) của chủ đầu tư. Trong đó có nội dung về bảo đảm an toàn chịu lực; an toàn phòng chống cháy nổ; bảo vệ môi trường.
4. Hai bộ bản vẽ thiết kế xây dựng trong hồ sơ thiết kế xây dựng điều chỉnh triển khai sau thiết kế cơ sở được phê duyệt theo quy định của pháp luật về xây dựng,
Bước 2: Nộp hồ sơ
Công trình, nhà ở riêng lẻ có giấy phép xây dựng được cấp bởi UBND cấp nào thì nộp ở cấp đó.
Nếu địa phương chưa thành lập bộ phận một cửa để tiếp nhận hồ sơ, thủ tục hành chính thì chủ đầu tư nộp hồ sơ điều chỉnh giấy phép xây dựng trực tiếp tại cơ quan Nhà nước có thẩm quyền trước đây đã cấp phép xây dựng cho công trình, dự án.
Bước 3: Tiếp nhận hồ sơ
Nếu hồ sơ đầy đủ và hợp lệ thì cấp biên nhận hồ sơ ghi rõ ngày hẹn trả kết quả. Trong thời hạn 7 ngày làm việc kể từ ngày nhận được hồ sơ, cơ quan có thẩm quyền cấp giấy phép xây dựng phải tổ chức thẩm định hồ sơ và kiểm tra thực địa.
Bước 4: Thẩm định hồ sơ
Trong thời hạn 12 ngày kể từ ngày nhận được hồ sơ điều chỉnh giấy phép xây dựng; các cơ quan QLNN được hỏi ý kiến sẽ trả lời bằng văn bản về những nội dung thuộc chức năng quản lý của mình.
Trường hợp sau thời hạn 12 ngày, nếu các cơ quan QLNN được hỏi ý kiến không có ý kiến thì được coi là đã đồng ý. Cơ quan có thẩm quyền cấp phép xây dựng căn cứ các quy định hiện hành để quyết định việc cấp giấy phép điều chỉnh.
Bước 5: Cấp giấy phép điều chỉnh
Trong thời hạn 30 ngày đối với công trình và 15 ngày đối với nhà ở riêng lẻ kể từ ngày nhận đủ hồ sơ hợp lệ; cơ quan có thẩm quyền xem xét hồ sơ để cấp giấy phép xây dựng điều chỉnh.
Bước 6: Trả kết quả
Trường hợp nào không được điều chỉnh giấy phép xây dựng?
Những trường hợp sau sẽ không được điều chỉnh giấy phép xây dựng.
– Xây dựng công trình sai cốt xây dựng.
– Xây dựng công trình vi phạm chỉ giới xây dựng.
– Công trình xây dựng không phù hợp với quy hoạch xây dựng được duyệt.
– Hành vi tổ chức thi công xây dựng công trình không có giấy phép xây dựng mà theo quy định phải có giấy phép hoặc xây dựng không đúng giấy phép mà hành vi vi phạm đã kết thúc.
Việc điều chỉnh giấy phép xây dựng sẽ tạo điều kiện cho chủ đầu tư thực hiện xây dựng theo quy định của pháp luật.
