UBND TP. HCM sẽ kiến nghị cho TP ban hành hệ số điều chỉnh giá đất (hệ số K). Để tính tiền sử dụng đất, tiền thuê đất đối với tất cả khu đất, thửa đất. Điều này sẽ giúp tiết kiệm thời gian 17 lần.
Tiền sử dụng đất là gì?
Theo Luật đất đai 2013 quy định thuế sử dụng đất như sau:
Tiền sử dụng đất là số tiền mà người sử dụng đất phải trả cho Nhà nước. Điều kiện là khi được Nhà nước giao đất có thu tiền sử dụng đất; cho phép chuyển mục đích sử dụng đất, công nhận quyền sử dụng đất
Đây là một nghĩa vụ có ý nghĩa thiết thực; đảm bảo việc người sử dụng đất có trách nhiệm đối với phần đất của mình được nhà nước giao, cho phép sử dụng, Nhà nước cũng có thể quản lý, giám sát chặt chẽ đối với phần đất này.
Đóng tiền sử dụng đất như thế nào?
Tiền sử dụng đất được Nhà nước quy định dựa trên những tiêu chí như:
– Diện tích đất
– Mục đích sử dụng đất
– Giá đất.
Nhà nước quy định việc xác định chế độ thu nộp tiền sử dụng đất đối với tổ chức kinh tế và hộ gia đình, cá nhân dựa trên cơ sở hồ sơ địa chính và quyết định của Ủy ban nhân dân cấp tỉnh phê duyệt giá đất cụ thể trong từng trường hợp. Sau khi đã có quyết định, cơ quan thuế tiến hành ra thông báo nộp tiền sử dụng đất. Sau đó sẽ gửi cho hộ gia đình, cá nhân, tổ chức sử dụng đất để thực hiện nghĩa vụ nộp tiền sử dụng đất.
Quy định về các đối tượng đóng tiền sử dụng đất như thế nào?
Theo Điều 2 Nghị định 45/2014/NĐ-CP quy định đối tượng chịu thuế sử dụng đất bao gồm:
Người được Nhà nước giao đất
a) Hộ gia đình, cá nhân được giao đất ở.
b) Tổ chức kinh tế được giao đất để thực hiện dự án đầu tư xây dựng nhà ở. Nhà này dùng để bán hoặc để bán kết hợp cho thuê.
c) Người Việt Nam định cư ở nước ngoài, doanh nghiệp có vốn đầu tư nước ngoài được giao đất. Nhằm thực hiện dự án đầu tư xây dựng nhà ở để bán hoặc bán kết hợp cho thuê.
d) Tổ chức kinh tế được giao đất thực hiện dự án đầu tư hạ tầng nghĩa trang, nghĩa địa để chuyển nhượng quyền sử dụng đất gắn với hạ tầng.
đ) Tổ chức kinh tế được giao đất để xây dựng công trình hỗn hợp cao tầng; trong đó có diện tích nhà ở để bán hoặc để bán kết hợp cho thuê.
Người đang sử dụng đất được Nhà nước cho phép chuyển mục đích sử dụng đất sang đất ở hoặc đất nghĩa trang, nghĩa địa
a) Đất nông nghiệp, đất phi nông nghiệp có nguồn gốc được giao không thu tiền sử dụng đất; nay được cơ quan nhà nước có thẩm quyền cho phép chuyển sang sử dụng làm đất ở; hoặc đất nghĩa trang, nghĩa địa.
b) Đất nông nghiệp có nguồn gốc được Nhà nước giao có thu tiền sử dụng đất; chuyển sang sử dụng làm đất ở; hoặc đất nghĩa trang, nghĩa địa có thu tiền sử dụng đất.
c) Đất phi nông nghiệp (không phải là đất ở) có nguồn gốc được Nhà nước giao có thu tiền sử dụng đất chuyển sang sử dụng làm đất ở có thu tiền sử dụng đất.
d) Đất nông nghiệp, đất phi nông nghiệp (không phải là đất ở) có nguồn gốc được Nhà nước cho thuê đất nay chuyển sang sử dụng làm đất ở; hoặc đất nghĩa trang, nghĩa địa đồng thời với việc chuyển từ thuê đất sang giao đất có thu tiền sử dụng đất.
Hộ gia đình, cá nhân
Hộ gia đình, cá nhân đang sử dụng đất làm nhà ở; đất phi nông nghiệp được Nhà nước công nhận có thời hạn lâu dài trước ngày 01 tháng 7 năm 2014 khi được cấp Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất phải thực hiện nghĩa vụ tài chính theo quy định của pháp luật.

Ông Lê Hoàng Châu, Chủ tịch Hiệp hội Bất động sản (BĐS) TP. HCM (HoREA), nhận định nếu được Chính phủ chấp thuận cho phép thực hiện thì đây là sự thay đổi có tính đột phá. Vì sẽ thực sự kéo giảm thời gian làm thủ tục hành chính để xác định tiền sử dụng đất xuống khoảng 10 – 15 ngày làm việc. Trước đây thời gian này là trên dưới 3 năm hiện nay (thậm chí lâu hơn).
Hạn chế tiêu cực, nhũng nhiễu

– Bảo vệ cán bộ công chức có thể bị vướng rủi ro trong thi hành công vụ khi thực hiện công tác định giá đất.
Bên cạnh đó nhà đầu tư có thể dự đoán được số tiền sử dụng đất để tính tổng mức đầu tư; có thể đánh giá được tính khả thi, không khả thi của dự án đầu tư. Từ đó quyết định có đầu tư hay không.
