Chính phủ vừa có tờ trình gửi Ủy ban Thường vụ Quốc hội về dự án Luật nhà ở (sửa đổi), với những thay đổi lớn trong chính sách nhà ở.
Sở hữu nhà chung cư có thời hạn?
Tờ trình của Chính phủ đã chỉ ra những bất cập, hạn chế cần sửa đổi Luật nhà ở, đó là quy định về sở hữu nhà ở, đặc biệt với nhà chung cư cũ không còn đủ an toàn buộc phải phá dỡ, cải tạo. Nguyên nhân là do pháp luật về nhà ở không quy định việc chấm dứt quyền sở hữu nhà chung cư, nên chủ sở hữu cho rằng đây là quyền vĩnh viễn.
Đáng chú ý, theo Chính phủ, luật hiện hành về đất đai không quy định cho phép người Việt Nam định cư ở nước ngoài hoặc cá nhân, tổ chức nước ngoài được nhận chuyển nhượng, sở hữu nhà ở.
Trong khi đó, pháp luật nhà ở, kinh doanh bất động sản lại quy định cho phép cá nhân, tổ chức nước ngoài được mua và sở hữu với nhà ở gắn liền với quyền sử dụng đất ở. Điều này gây khó khăn trong nhận quyền sở hữu với nhà ở cho đối tượng là cá nhân, tổ chức nước ngoài
Trên cơ sở đó, dự án Luật nhà ở (sửa đổi) được xây dựng nhằm hoàn thiện quy định, giải quyết tình trạng chồng chéo, mâu thuẫn trong chính sách. Tờ trình dự thảo mới vì thế bổ sung, sửa đổi thêm nhiều quy định.
Với nội dung liên quan đến việc sở hữu nhà chung cư, dự thảo quy định nhà chung cư hết thời hạn sử dụng, hoặc chưa hết thời hạn nhưng buộc phải tháo dỡ theo quy định sẽ phải chấm dứt quyền sở hữu. Như vậy, khác với các dự thảo đưa ra trước đây Chính phủ đưa ra đề xuất sở hữu nhà chung cư có thời hạn.�
Theo đó, thời hạn sử dụng nhà chung cư được xác định theo hồ sơ thiết kế và thời gian sử dụng thực tế, được ghi rõ trong văn bản thẩm định.
Tuy nhiên, dự thảo quy định chủ sở hữu nhà chung cư thuộc diện phá dỡ sẽ được quyền tiếp tục sử dụng diện tích đất có nhà chung cư, nhưng phải đóng góp kinh phí xây dựng chung cư mới.
Người Việt ở nước ngoài, người nước ngoài được sở hữu nhà ở có thời hạn ra sao?
Về sở hữu nhà, dự thảo bổ sung thêm các trường hợp có yếu tố nước ngoài được sở hữu nhà ở. Cụ thể, người Việt Nam định cư ở nước ngoài được phép nhập cảnh vào Việt Nam; các tổ chức kinh tế có vốn đầu tư nước ngoài đầu tư xây dựng nhà ở theo dự án; tổ chức có chi nhánh, văn phòng đại diện; cá nhân người nước ngoài sẽ được sở hữu nhà.
Theo đó, người Việt Nam định cư ở nước ngoài được sở hữu nhà thông qua hình thức đầu tư xây dựng nhà ở trên diện tích đất được thừa kế, tặng cho, mượn, thuê hoặc nhận chuyển nhượng theo quy định; mua, thuê nhà ở thương mại; mua nhận tặng cho, nhận đổi, thừa kế…
Việc sở hữu nhà ở của những trường hợp này sẽ là những dự án đầu tư xây dựng nhà ở thương mại, khu đô thị có nhà ở, và phải đáp ứng các điều kiện liên quan. Tuy nhiên, loại trừ dự án nằm trong khu vực cần đảm bảo quốc phòng, an ninh theo quy định do Bộ Quốc phòng, Bộ Công an thông báo
Đáng chú ý, dự thảo quy định tổ chức, cá nhân nước ngoài khi được sở hữu nhà ở, thì chỉ được mua, thuê mua, nhận tặng cho, thừa kế và sở hữu không quá 30% số lượng căn hộ trong một tòa chung cư.
Trường hợp nhà ở riêng lẻ tại khu vực có số dân tương đương một đơn vị hành chính cấp phường, chỉ được sở hữu không quá 250 căn nhà. Việc sở hữu nhà ở với những trường hợp giao dịch mua bán, thuê mua, tặng cho, nhận thừa kế thì quyền sở hữu không quá 50 năm và được gia hạn thêm nếu có nhu cầu.
